Community Rules and Regulations of Marjal Beach Residential
The present regulations, as stipulated in the Horizontal Law Article 6, wish to regulate the co-existence rules and usage of communal elements. These rules are to be followed and implemented by all the owners and their families as well as by guests, tenants and employees and inform the President or the Directive Board should they be ignored.
USE OF THE APARTMENTS AND COMMUNAL AREAS/FACILITIES
Article 1.
Installation of any antennas on top of the buildings including the façade (the façade being all the exterior part of the building) will require authorisation prior to installation. Authorisation will be granted if the installation wiring and canalization does not affect the façade terraces or windows of the building.
Article 2
Owners are not allowed to make any alteration or changes to the façade, railings, windows, lattices, blinds, lights, etc., with any paint. The shape and colour of awnings must not be changed from the original shapes and colours as established by the Community.
Article 3
Use of the Elevator. No large or heavy objects are to be transported in the elevator as this could cause damage and pose a safety risk.
Article 4.
It is prohibited to hang clothes or laundry on the balcony railings (inside or outside). It is preferable to use the inside of the terraces and balconies out of sight.
Article 5.
The Swimming Pool, Spa and Gym areas can only be used during the times agreed by the Community. The Directive Board may issue a compulsory card system or other type warning if the times are not adhered to.
The instruction boards inside and outside these areas must be adhered to by all residents.
It is forbidden inside the areas of Article 5:
- a) To eat. (drinks are allowed) but must be in plastic containers. Glass is strictly forbidden.
- b) To play ball or any other games that might disturb other users.
- c) To swim without a cap when wearing long hair.
- d) To take children without appropriate supervision.
- e) To wear inappropriate clothing.
- f) To take animals.
- g) To ignore directions given by the lifeguard or any other person in charge. Any person who does not comply with this will be asked to leave the area.
Article 6.
The Directive Board will be responsible for maintaining the Pool and other Communal areas Regulations.
Article 7.
Any owner(s) who may wish to ‘let’ their property are obliged to notify the President or Administrator, who will provide authorization for any Tenants or Guests of the Owner to use the Communal areas, provided they adhere to the Community rules.
The Communal Internal Rules and Regulations are to be followed by Owners, Tenants and Guests in relation to the apartments and their relevant parking spaces.
Article 8.
Meetings and Celebrations.
Consent must be given by the President or Vice-president prior to these taking place. If this is not possible then another Block’s President/Vice-president consent should be sought.
Excluded times for the above are as follows:
14:30hrs – 17:30hrs.
24:00hrs – 10:00hrs.
Rationale for this is residents having the right to enjoy their free-time, utilize communal areas and enjoy a peaceful and relaxing atmosphere within their own apartment/home.
Article 9.
Noise levels are to be kept to a minimum as to avoid disturbing other residents, particularly during the protected times as mentioned in Article 8
Article 10.
Ball and similar games are forbidden inside communal areas to prevent damage to parked cars and pool users being disturbed.
Article 11.
The leaving of personal rubbish, bikes, furniture items, tools, and gadgets within communal areas is strictly forbidden. Communal areas in this sense include, halls, stairways, parking areas etc,.
Article 12.
The use of open fire BBQ’s on balconies and terraces are forbidden due to possible smoke and fire damage. Electrical equipment is allowed.
Article 13.
Owners of dogs that are walked around Communal areas must have an appropriate sanitary card.
All dogs must be kept on a leash whilst in the complex.
Dogs that fall in the category of ‘dangerous dogs’ by the authorities, must be adequately muzzled.
Owners must clear foul waste from their dogs, using appropriate dog scoops/bags and discard waste in refuse bins outside the complex.
Owners are responsible to keep noise levels to a minimum in relation to their dog barking.
The Directive Board has the authority to contact the Municipal Services to remove any animal from the complex if the owner does not comply with the obligatory requirements above.
Article 14.
In the case of any of the rules and regulations being ignored or any acts carried out that alter the normal coexistence of the building, the person responsible will be asked to cease this activity and may then be subject to a Community reprimand, resulting in acts being published on Block Notice Boards.
Should this continue to persist, the Directive Board can and will cease the person’s right to use communal areas taking action in accordance with Article19 of the Horizontal Law.
If Community rules are infringed by tenants or guests then any resident has the right to challenge this aside from the Directive Board.
Owners of apartments will be held to account for any action or behaviour that results in their guests or tenants disregarding any of the Community Rules.
